PRIZE COMPETITION: A Prize Competition is one where the outcome is determined by the application of skill, judgement or knowledge.
PRIZE: A prize is a money or something that has monetary value that is given to someone who wins a prize competition.
OPENING/CLOSING DATES: The time frame set by the promoter to participate in a prize competition.
QUALIFYING QUESTION: It refers to a test of knowledge and skill required for those wishing to participate in a prize competition.
QUIZ: Refers to the skill and knowledge test by an independent application such as software or a website or service to determine the qualified entrants in an exclusive prize competition.
USER: Those who register for an account on the website via a mobile device such as a phone, a tablet, or a computer.
ACCOUNT: An account is an identity created for a user on the website.
ENTRY(S): Refers to each participation in a prize competition.
MAXIMUM NUMBER OF ENTRY: It is the maximum number of paid or postal entries specific to each prize competition.
MAXIMUM NUMBER OF ENTRY PER USER: The number of entries that each user can choose to participate in a prize competition via paid route.
ENTRANT(S): It refers to the person or user (‘You’, ‘Your(s)’, ‘Customer’) who have used either paid and postal entry route and answered the qualifying question among those who want to participate in a prize competition.
QUALIFIED ENTRANT(S): It refers to the person or user who have correctly answered the qualifying question among those who want to participate in a prize competition.
FREE DRAW: Refers to the selection process by a third party web service or an independent individual, an independent company or an independent panel of judges to determine the prize winner among the qualified entrants.
WINNER(S): Refers to the user or individual who has won a prize competition as a result of a free draw.
PAID ENTRY: It is a paid route for a user to participate in a prize competition with their own account via the website.
POSTAL ENTRY: It is a free route for a user to enter a prize competition by mail.
GENERAL:
Users visiting the website who wants to participate in a prize competition as an Entrant(‘User’, ‘You’, ‘Your(s)’, ‘Customer’, ‘They’, ‘Their’) are deemed to have read, understood and accepted these Terms and Conditions. Users are deemed to have agreed to be bound by them.
The promoter(‘We’, ‘us’, ‘our’) reserves the right to update these terms and conditions at any time. The latest updated version of these terms and conditions is published on the website.
The failure of the promoter to enforce any clause of these terms and conditions does not constitute a waiver of the promoter’s right to do so.
Giveawaybox Prize Competitions are run by the promoter and the promoter reserves all rights to all published content on the website.
These terms and conditions shall not constitute or be construed as a contract or any type of agreement between any entrant and the promoter.
These prize competitions are governed by English law. Any dispute will be dealt with in accordance with English law. Exclusive jurisdiction rests with the English Courts.
CREATING AN ACCOUNT
You have to register for an account on the website if you wish to participate in a competition by using either paid and postal entry route.
When creating an account, a user has to share with the promoter their full name, e-mail address, residence address, mobile phone number and necessary contact information including but not limited to. Your mobile phone number must be verified during registration for security reasons. In this context, a verification code will be sent to your phone number during registration through Google’s OTP services. To maximize the user experience, you can use OTP while logging into your account without entering your password or e-mail address. Your information will be kept under the ‘Privacy Policy’ and is required to reach the winner as a result of a prize competition, verifying the age and identity of the entrant/winner. The user is responsible for providing correct contact and other personal information. The promoter is not responsible for the user’s incomplete or incorrect contact and/or personal information.
Users agree that e-mail may be sent from time to time for marketing communication to the e-mail address they have provided. Users can unsubscribe from the e-mail list at any time.
A user can request deletion of their account from the promoter’s website. In this case, when a request is submitted, the promoter will fulfil it as quickly as possible.
ELIGIBILITY & PARTICIPATION
Participation in prize competitions on the website is open to anyone residing in the United Kingdom, aged 18 and over; except directors of the promoter, employees of the promoter, employees of agents or suppliers of the promoter who are professionally connected with the prize competition or its administration or members of the immediate families or households of above.
By participating in a prize competition and accepting these terms and conditions, you must ensure that you are not breaching the current laws of your country of residence. The promoter is not responsible in any way when you breach the laws of your country of residence by participating in a competition on the website.
After registering with us, you can enter our prize competitions by following the instructions on the website.
If you want to participate in a prize competition for free, you must have an active account at the same time on the website. Please check the Postal Entry Route to enter a prize competition for free.
The promoter reserves the right to refuse or disqualify any entry(s) if it has reasonable grounds to believe that a user has contravened any of these terms and conditions.
The promoter is not responsible for competition entries that are not completed, lost, or delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
PRIZE COMPETITIONS
The maximum number of entries, maximum entry number per customer, prize type, prize competition type, qualifying question, quiz, opening/closing date and time, entry fee (only for participation via the website) are specific to each prize competition and this information is at the discretion of the promoter.
There are two types of prize competitions in Giveawaybox. Standard and Exclusive. (a) Standard: Entrants who correctly answer the qualifying question in prize competitions, ie qualified entrants, will be included in the entry list by directly participating in the free draw. (b) Exclusive: Entrants who answer the qualifying question correctly in prize competitions are subject to another skill and knowledge test. This skill and knowledge test includes a set of multiple-choice questions and it is time/point-based. In the second test, the most successful 50% of the entrants are eligible to become qualified entrants and are included in the entry list to the free draw.
When you wish to participate in a prize competition, you are required to answer the qualifying question even the type of competition standard or exclusive. By participating in a Standard Prize Competition, only the entrant who answers the qualifying question correctly gets the title of the qualified entrant. Qualified entrants are subject to be included in the free draw entry list.
All entry pricing related to prize competitions is at the discretion of the Promoter. An entry price may differ for promotional reasons during the opening/closing time for any prize competition.
No payment is required to participate in any prize competition. A free entry route is available in every prize competition. For details, please read the Postal Entry Route.
Payments made to enter a prize competition through the website become the property of Promoter and these payments are non-refundable. By entering a prize competition with a payment, you agreed and acknowledged that your payment is non-refundable under these terms and conditions.
If all entries are taken before the closing time, the prize competition will automatically be closed to participation.
The Promoter reserves the right to extend the closing time of a prize competition 2 times at its sole discretion. In the event that the closing time is extended twice and not all available entries are taken, the free draw will be held between the currently qualified entrants. In this case, as the winner, you agreed and acknowledged that you will be paid 70% of the total amount collected only from the paid entries of the relevant competition and the announced prize will remain with the promoter. In this case, the payment will be made through a money transfer to the winner’s UK bank account.
The promoter reserves the right and at its sole discretion to cancel a prize contest before closing time and/or before the free draw if it has reasonable grounds. In this case, the amount paid by the entrants cannot be refunded in cash or money order. In this case, a coupon code will be provided which is equal to the amount paid by the entrant to use it in another prize competition.
The promoter may cancel, terminate, change or suspend a prize competition at its sole discretion (a)if for any reason any aspect of the competition is not working as planned, (b)if the website fails due to a virus, DDoS attack, hacking, network failure, errors, tampering, fraud or technical malfunctions, (c)or if any event occurs beyond the promoter’s control that impairs or affects the administration, safety, fairness, integrity or proper conduct a prize competition.
THE FREE DRAW: All qualified entrants in the entry list in the prize competition will be included in the related free draw. A free draw is subject to be broadcasted live on our official Youtube and/or Facebook pages. A free draw is held under the supervision of the public, using Google Random Number Generator, https://www.wheelofnames.com or pickerwheel.com which are publicly accessible third-party web services. The ticket numbers in the relevant entry lists are shared with these services and then they perform a random selection. This 3rd party services’ random selection will determine the winner.
Entry lists will be announced for each prize competition on the website. For being transparent, Qualified entrants and/or winners agreed to have their names posted on the website under these terms and conditions.
The free draws calendar is always updated on the website.
A prize competition may have multiple prizes. Therefore, there can be multiple winners in a prize competition.
In a prize competition, the promoter cannot guarantee that an entrant will win a prize.
The promoter will try to reach the winner as a result of a free draw during the live broadcast. A winner is solely responsible for the accuracy of the contact information they provided.
The Promoter is obliged to make the necessary notifications to the winner of the prize by phone call and/or e-mail after the free draw. In addition, a prize competition winner will be announced on the website.
The promoter cannot be held responsible if a winner cannot be reached during or after a live broadcast due to incorrect contact information.
After the promoter notifies the winner and the winner is announced on the website, the winner must reach the promoter within 10 working days for the delivery process of the prize. If the winner is unable to receive the prize for their own reasons and/or contravened these terms and conditions, the prize delivery process will be suspended and the free draw will be repeated to select a substitute winner.
The promoter will check the identity, age and residency of the winner. As the winner, if you fail or refuse to provide confirmation of your identity, age and residency you will forfeit your prize.
The promoter may ask the winner’s consent to take a photo with the prize. This photo will be posted on the website for marketing purposes, public relations as well as proof of prize delivery.
Depending on the type or form of the prize, delivery can be made in person or by mail. The type of prize delivery is at the discretion of the promoter.
If the prize is set as Cash, the prize will be transferred to the winner’s UK bank account. A cash prize can only be delivered in GBP currency to the winner through a bank or EMI (electronic money institution). A cash prize cannot be converted into any other form such as cryptocurrency or gold, and there is no such alternative. In order to complete the cash prize delivery, the winner agrees to share their bank account information with us.
Delivery within the United Kingdom is free if the prize is posted by mail to the winner’s home address. Face-to-face delivery may be required depending on the prize type. If delivery in person is necessary, the promoter is not responsible for any expenses incurred by the winner.
If a competition prize is a physical thing that has monetary value, the promoter may offer a cash alternative as a prize specifying beforehand it in the conditions of the competition and this is at the sole discretion of the promoter.
All responsibility for the prize rests with the promoter until the prize is delivered to the winner. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. A prize is not convertible, nor is it transferable to a third party.
POSTAL ENTRY ROUTE
To enter a prize competition for free, you must follow the instructions below.
Users must first have an active account on the website. The prize competition you wish to enter, your answer to the related qualifying question, your full name, e-mail address, date of birth, home address and mobile telephone number should be written on a postcard and sent two business days before the closing time of the related prize competition to Giveawaybox Limited, Unit 83356, PO Box 15113, Birmingham, B2 2NJ.
You are solely responsible for the accuracy of the information you submit. If any of the personal information you have submitted is incomplete, incorrect and/or does not match the information in your active account, the free entry will not be accepted by the promoter. If the information in your account is correct and matches the information you have submitted, furthermore, if you have answered the qualifying question, your participation will be confirmed and you will become an entrant.
Users using the postal entry route are also deemed to have read, understood and accepted these terms and conditions.
THE WEBSITE
You are not allowed to use the website other than for your personal use and participation in prize competitions.
All digital materials such as any logo, content, or image on the website are copyrighted and cannot be used for any purpose without the permission of the promoter.
You hereby agree that accessing the website, participating in prize competitions, creating/accessing/using an account while residing in any jurisdiction other than the United Kingdom is strictly prohibited.
In case of detection of the following and not limited to similar actions, the promoter will suspend the user’s account temporarily or permanently without any notification. (a) The User’s behaviour to manipulate the operation of the website and/or prize competitions by using any method, (b) The User’s transferring his/her account to someone else or allowing someone else to use it, (c) The User’s actions that violate the rights of third parties. (d) The information, content and texts shared by the user on the website contain threats, aggression, racism, obscenity.
The website has a responsive design, but the promoter does not guarantee that the website will always display correctly on any device or browser. The Promoter shall use its best endeavours to ensure that the website used to operate its Prize Competitions perform correctly across the latest versions of the popular internet, tablet and mobile browsers.
The Website may contain hyperlinks to websites operated by parties other than us. Such hyperlinks are provided for your reference and convenience only. We do not control such websites and are not responsible for their content and/or the privacy or other practices of such websites. It is up to you to take precautions to ensure that whatever links they select and/or software you download from such websites are free of viruses. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites, association, sponsorship and/or partnership with their operators.
LIABILITY
Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss because of any act or omission by the Promoter, or its servants or agents, in connection with the supply arrangement, or the supply, of any goods by any person to the Prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.
The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes.
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Prize Competition to the correct Entrant. If due to hardware, software, or another computer-related failure, or due to human error, the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant at its sole discretion without admission of liability.
The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.
MISCELLANEOUS
Promoter may assign or otherwise their rights and/or obligations under these terms and conditions in whole or in part to any third party at its sole and absolute discretion and without your consent. The Promoter may also assign these terms and conditions in their entirety, without your consent, to its successor in interest in connection with a merger, reorganisation, or sale of all or substantially all assets or equity. These terms and conditions shall bind and inure to the Promoter’s benefit, its successors and permitted assigns.
According to the Gambling Act 2005, The Promoter’s prize competitions cannot be considered as lottery, as the prize competitions held and administered by the Promoter on its website include a skill and knowledge test, and either has paid and free entry route.
If the Promoter has reasonable grounds or believes that these terms and conditions have been contravened by a user or entrant, the relevant entries will be cancelled and no refunds will be made if any payment has been made.
Entries that are cancelled due to the violation of a clause under these terms and conditions will not be deducted from the total number of entries currently taken.
